Supreme Court Restores Promotion Benefits for Elementary Teachers

The Supreme Court has issued an important ruling on the promotion of elementary school teachers.

The decision was written by Justice Ayesha Malik.

The court said that creating ambiguity in promotions and seniority is against good governance.

It added that taking back promotions also goes against good governance.

The Supreme Court further ruled that any ambiguity in laws and rules cannot be used to the disadvantage of an employee.

The court annulled the May 24, 2023 order of the Punjab Service Tribunal and the Education Department.

It also directed that the petitioner be given all previous benefits from the date the promotion was withdrawn.

The petitioner, Muhammad Shafiq, an elementary school teacher, had been promoted to BS-16.

However, the Punjab Education Department withdrew the promotion order on May 24, 2023.

The department had cited a “note” in the 2014 service rules to justify withdrawing the promotion order.

The Punjab Service Tribunal had upheld the department’s decision, but the Supreme Court has now overturned it.
