A US federal judge on Monday blocked the immediate implementation of new Trump administration rules that would have tightened limits on foreign students and journalists staying in the United States.
District Judge Dennis Saylor issued a preliminary injunction one day before the Department of Homeland Security’s new visa rules were set to take effect. The order temporarily stopped the policy without deciding the main legal challenge.
Under the proposed rules, foreign students would have been allowed to stay in the US for up to four years before applying for an extension. International students currently remain for the duration of their studies.
The rules would also have cut the stay for foreign journalists to 240 days, with possible extensions, while Chinese journalists would have faced a 90-day limit.
A coalition of universities, teachers and journalists had challenged the policy in court.
In his memo, Saylor questioned the government’s arguments and warned that the rules would give DHS officials broad power to deny extensions without appeal. He also said the national security justification “borders on the absurd.”
The judge scheduled the next hearing for October 2.
