Pakistan is moving to clarify the legal framework governing telecom companies’ use of Right of Way as the government reviews proposed amendments to the Pakistan Telecommunication Reorganization Act.
Law Minister Senator Azam Nazeer Tarar has directed the Ministry of Information Technology and Telecommunication to address legal and practical issues in the proposed Pakistan Telecommunication Reorganization Amendment Bill 2026, with Right of Way provisions emerging as a key area of concern.
A committee chaired by Tarar reviewed the proposed amendments and the existing legal framework governing the installation of telecom infrastructure and the use of Right of Way. Federal Minister for Information Technology and Telecommunication Shaza Fatima and senior officials from both ministries attended the meeting.
The review covered the respective jurisdictions of federal, provincial and local authorities over public, common development and private properties. Officials also examined requirements for obtaining written consent from property owners before installing telecom infrastructure on private property.
The discussions also covered compensation and other legal requirements linked to the use of Right of Way. Tarar said the government needed to strike a balance between expanding telecom infrastructure and protecting private property rights.
He said legal ambiguities surrounding Right of Way needed to be removed through a clear and workable framework. The government, he added, would support the expansion of digital connectivity while ensuring that property owners’ rights are protected.
The committee also reviewed a proposal to bring new and emerging technologies within the legal framework through appropriate rules and regulations. The discussions included defining the responsibilities of telecom companies and property owners for protecting, maintaining and restoring properties after infrastructure is installed.
The Ministry of Information Technology and Telecommunication was directed to finalize the proposed legislation after addressing the identified legal and practical issues and present it to the committee for further consideration.
