The Lahore High Court has ruled that the division of inherited property will attract a fixed stamp duty of just Rs500, not a 2 percent levy.
The court accepted a writ petition filed by citizen Muhammad Sajjad. Justice Tanveer Ahmad Sheikh accepted the petition and issued a written verdict, a five-page decision that has been set as a judicial precedent.
According to the decision, subordinate courts had cited no legal justification for the 2 percent duty. The court set aside the 2025 decisions of the civil judge and the additional sessions judge, ruling that the Stamp Act 1899 fixes the duty on inheritance partition at Rs 500.
The court observed that making other co-owners parties to the case does not change the nature of the suit, and that a percentage-based financial burden cannot be imposed without legal authority.
