The Islamabad High Court (IHC) has directed authorities not to take coercive or unlawful action against sheesha cafes and restaurants operating in accordance with the law.
At the same time, the court ordered Islamabad Police to continue strict action against illegal sheesha cafes and businesses found violating the law or permit requirements.
The IHC also sought a response from the federal government and directed the authorities to finalize and implement rules governing sheesha cafes within one month.
The court further ordered the federal cabinet to approve the relevant laws concerning restrictions on sheesha smoking at the earliest. The Advocate General Islamabad and the Additional Attorney General were directed to take up the matter with the relevant authorities.
During the hearing, the court observed that protecting the younger generation from drugs and sheesha smoking is the responsibility of the government. It also expressed concern over the absence of a proper legal framework for sheesha cafes.
The authorities were directed to finalize the rules within one month and submit a compliance report to the court.
The Anti-Narcotics Force (ANF) was also directed to cooperate with Islamabad Police in efforts to eliminate drugs.
The court clarified that restaurants operating legally should not face unlawful action. However, strict legal action should be taken where a business is found violating the law or the conditions of its permit.
The IHC also ordered all related petitions to be clubbed together and adjourned the hearing until October 13.
