Austria Eases Work Permit Rules for Foreign Workers

Austria has introduced new immigration rules allowing foreign workers to change employers more easily, retain their work permits during unemployment, and benefit from faster application processing.

The changes, which took effect on August 7, 2026, aim to provide greater flexibility for foreign workers and employers.

Under the new rules, single permit holders can change employers with approval from the relevant authorities. However, if no decision is issued within 45 days of submitting an application, they can begin working for the new employer.

The changes do not apply to intracompany transfer (ICT) permit holders, while existing rules for EU Blue Card holders remain unchanged.

Austria has also introduced a six-month grace period for eligible foreign workers who lose their jobs, allowing them to retain their work permits while looking for new employment. Previously, this option was available only to EU Blue Card holders.

Affected workers must inform the authorities when their employment ends. The six-month period may be extended in certain circumstances, although intracompany transferees, posted workers, and some other permit holders are excluded.

The government has also shortened standard immigration application processing times to 90 days after submission of a complete application, with certain exceptions.

Existing shorter deadlines for Red-White-Red Cards and EU Blue Cards remain unchanged, while some applications involving posted workers and self-employed individuals may take longer.

The reforms are expected to make it easier for foreign workers to find new employment without immediately leaving Austria. They may also help employers retain skilled workers, although easier job changes could increase competition for foreign talent.
