The Lahore High Court has ruled that once a person becomes a tenant, he remains a tenant until he hands over possession of the property to the owner.
The court made it clear that a tenant cannot continue occupying property by relying on the ownership claim of a third party.
It upheld the eviction order against shop tenant Nahal Din and dismissed the ownership objection petition filed by Bilqis Begum.
Justice Muzammal Akhtar Shabbir issued the written verdict and said Bilqis Begum failed to present sufficient evidence in support of her ownership claim over the shop.
The court noted that the shop had already been excluded from the earlier eviction order, and said the petition appeared aimed at protecting the tenant rather than safeguarding legal rights.
The Lahore High Court ruled that no legal or jurisdictional defect existed in the decisions of the lower courts, and therefore dismissed the appeal.
Following the verdict, the eviction order against tenant Nahal Din will remain in force.
