Peshawar University Reclaims Rs. 5 Billion Property After Decades-Long Court Battle
The University of Peshawar (UoP) has taken possession of a bungalow worth Rs. 5 billion in University Town following a 22-year legal battle.
Located on Gul Maher Lane, the property spans more than nine kanals and was donated by the late Begum Kulsoom Amin Durrani through a registered waqf deed on January 2, 1974.
The property was dedicated to student welfare, with income generated from it expected to fund up to 350 scholarships for deserving students across Khyber Pakhtunkhwa.
The legal dispute began on September 21, 2004, when the university approached a civil court seeking legal title and possession of the property.
On June 22, 2013, the court declared the property a waqf, recognized the university as its mutawalli (trustee), and barred the defendants from selling or transferring it.
The ruling was challenged, but the Additional District Judge-II, Peshawar, dismissed the appeal on November 15, 2023.
The Peshawar High Court subsequently lifted the stay order on March 23, 2025, before dismissing the opposing party’s civil revision petitions on October 15, 2026.
Earlier, on October 9, the executing court had directed the SSP Operations, Peshawar, to provide police assistance to the court bailiff to enforce the possession order.
The legal proceedings concluded with the court bailiff handing over possession of the bungalow to the university’s registrar on Friday, October 16, in accordance with the court orders.
